Enugu withdraws from Supreme Court lawsuit challenging EFCC’s legality

The Enugu State Government has formally withdrawn from a Supreme Court lawsuit involving 16 states that challenges the legal authority of the Economic and Financial Crimes Commission (EFCC) and other anti-corruption agencies.
This lawsuit, initiated by Kogi State in 2023 and joined by several states, questions whether federal agencies like the EFCC and the Nigeria Financial Intelligence Unit (NFIU) have the right to investigate state-level financial matters without state government approval.
Enugu’s Attorney General, Dr. Kingsley Udeh, filed a formal request for the state’s withdrawal from the case on October 21, 2024.

However, due to processing delays, the request was not officially recorded by the Supreme Court until October 24. Enugu’s exit follows the recent withdrawal of Ebonyi, Anambra, and Adamawa on October 23, reducing the number of states still involved.
The Supreme Court is expected to set a date for the case’s judgment, which remains a significant constitutional matter regarding the jurisdiction of federal anti-corruption bodies over state affairs.
